Terms and Conditions

1 General terms

1.1 You must be at least 13 years old in order to create an account on www.peopleplotr.com or have obtained parental consent to create an account. Parental consent can only be obtained by going through the process outlined here.

1.2 You must obtain the consent of all people you feature on your people plot, unless they are fictional, deceased or public figures. For under 16-year-olds (or those deemed under law in your country not to be able to provide consent), you must obtain the consent of their parents or legal guardians before featuring them on your people plot.

1.3 You agree to anonymize information about vulnerable people such as children by not including their full name or date of birth, and take reasonable steps to protect the privacy of people you feature on your people plots.

1.4 You agree to remove any content from your people plots about people who have not provided consent (except for fictional, deceased or public figures), or to inform us of such content. We will then delete it ourselves.

1.5 You agree that PeoplePlotr can use the data you provide us as outlined in our privacy policy. We aim to collect the minimum personal information from users necessary to ensure our service functions properly and for us to meet our legal, accountancy and customer service obligations. 1.6 You may only set up one free standard account.

1.7 Plots created using PeoplePlotr must only be for the use of the individual or company that set-up an account. It is strictly forbidden - unless permission has been given by the owners of PeoplePlotr - for an individual or company to sell plots created on PeoplePlotr to another individual or company. Nor can an individual or company employ another individual (unless the individual is a direct employee of the company that owns the account with PeoplePlotr) or company to create a people plot for them, unless permission has been given by PeoplePlotr.

1.8 You must own the intellectual property (copyright and trademarks) or have permission from the copyright/trademark holders for any images, videos or other content you include in a PeoplePlotr plot.

1.9 You agree that the Service contains copyrighted material, trade secrets, and other proprietary intellectual property that are property of Webalon, the operator of PeoplePlotr.com. Webalon and PeoplePlotr are protected by copyright, trade secret, and other proprietary rights and laws, and this content can only be used or accessed as specifically provided for in these terms of service.

1.10 You may not store any of PeoplePlotr.com (including any portion of the software or documentation) on any computer or other device, or copy or otherwise use such information to create derivative works.

1.11 You are responsible for maintaining the security of your account and password. We will not be liable for loss or damage due to failure to comply with this obligation.

1.12 The services offered through this site are provided as-is and without warranty. We may discontinue the service or cancel accounts at any time with or without reason.

1.13 Though we do everything possible to maintain a reliable service, PeoplePlotr cannot guarantee that the Service will be error free or uninterrupted, and cannot be responsible data loss. Under no circumstances will PeoplePlotr.com and its owner Webalon bear any responsibility for any damages arising as a consequence of such unavailability.

1.14 You agree to defend, indemnify, save and hold PeoplePlotr harmless from any and all demands, liabilities, losses, potential losses, claims, costs and expenses (including attorney's fees), asserted against PeoplePlotr.com, its affiliates, subsidiaries, partners, agents, customers, officers, contractors, and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by you.

2 Account Types

2.1 The Bronze account is only available to individuals and small community groups. For business use, the Silver or above accounts must be used. Those who break this condition could have their accounts deleted without warning.

2.2 The Education account is only available to currently employed individual teachers. Users of the free Bronze accounts that come with the Education account must be current pupils at the school where the teacher who manages the Education account resides. Those who break these conditions could have their accounts deleted without warning.

2.3 The Education account is only to be used for educational purposes. It is strictly not to be used by colleges, universities or schools for marketing or other non-educational purposes. Those who break these conditions could have their accounts deleted without warning.

3 Acceptable Use

3.1 PeoplePlotr.com does not allow any of the following content, or links to external sites containing such content, on plots created by users:

(i) Pornographic or sexually explicit material

(ii) Content of an illegal nature, including copyright materials

(iii) Content that is deemed to be threatening, obscene or that has the purpose of inciting hate

3.2 You may not decompile, disassemble, reverse engineer, copy, create a derivative work, or display the PeoplePlotr Software code in human readable form, or otherwise use PeoplePlotr.com (which includes its software and documentation) except as explicitly provided for in this agreement.

3.3 You agree that you will not store, copy, modify, rent, lease, loan, sell, distribute, transfer, transmit, display, reverse engineer, reverse assemble, or otherwise attempt to discover any programming code or any source code used in or with the Services. You may not sell, assign, sublicense, grant a security interest in or otherwise attempt to transfer any right in the Services (which includes its software and documentation), create derivative works based on or in any manner commercially exploit the Services, in whole or in part.

4 Account/Chargeback terms

4.1 All premium accounts are billed in advance. Monthly plans rebill every 30 days. Education accounts are billed a year in advance. We cannot provide refunds or cash credits for account downgrades or cancellations.

4.2 Cancellation of a premium account must be submitted seven business days prior to the rebilling date.

4.3 All premium accounts are billed in advance, and are non-refundable.

4.4 People plots may be deleted following account cancellation.

5 Miscellaneous

5.1 If for any reason any provision of these terms of service shall conflict with any statute, law, regulation or ordinance, then in such event the provision in question shall be modified only to the extent necessary to bring it within such requirements, and (as modified) these terms of service shall continue in full force and effect.

5.2 We reserve the right to modify these terms and conditions at any time and for any reason, with or without explicit notification to you. Continued use of the Site after any such changes shall constitute your consent to such changes. It is the user's responsibility to check these Terms and Conditions from time to time.
